This violation occurred due to a lack of communication between the Point of Caring maintenance staff and the laboratory conducting the test, and the failure to implement a 2-point checking system. Adhering to this regulation is imperative to ensuring the individuals have access to a clean and safe water source. The water test, as of the time of licensing was up to date. A water test was conducted on Tuesday February 7, 2023. A schedule, based off of this date was emailed to the laboratory, which will adhere to the 90 day water test regulation. To ensure regulatory compliance and avoid violations of 55 PA code 6400.68(c), Point of Caring, Inc. will provide additional training to the maintenance staff regarding the time frame required within the Regulatory Compliance Guide 55 PA Code 6400.68(c). This training will be completed as of February 10, 2022. In addition to this training, Point of Caring, Inc. has contacted the laboratory regarding schedule requirements for the site. A first aid manual shall be kept with the first aid kit.Point of Caring, Inc. was in violation of 55 PA code 6400.77(b), by failing to ensure that the first aid kit at the home contained a manual. This violation occurred due to a of lack of attention to ensuring all required items were stored in the first aid kit. Adhering to this physical site regulation is critical in providing necessary safety for the individuals by ensuring that all necessary first aid items are immediately accessible if first aid is necessary. The manual is necessary in aiding staff by informing them of the items in the first aid kit and how to properly utilize all items. In order to correct this violation, a manual was placed in the first aid kit immediately. To ensure regulatory compliance and avoid violations of 55 PA code 6400.77(b), Point of Caring, Inc. will provide additional training to the house administrator and direct care staff that work at this site. This training will be completed at a house meeting scheduled for Friday February 16, 2023 at 9:00 am. Point of Caring, Inc. was in violation of 55 PA code 6400.142(g), by failing to ensure that dental hygiene plans were written annually. This violation occurred due to a of lack of knowledge regarding the person responsible for completing the dental hygiene plan. Adhering to site regulations is critical in providing a comprehensive plan to ensure adequate dental care in the home. In order to correct the violation, a dental hygiene plan was put in place immediately and is now located at the home. To ensure regulatory compliance and avoid violations of 55 PA code 6400.68(c), Point of Caring, Inc. will provide additional training to the house administrator and the office personnel in charge of medical oversight on dental regulations within the Regulatory Compliance Guide 55 PA Code 6400. regulations regarding regulatory compliance maintaining the mandatory dental hygiene plan requirements for all individuals receiving services from Point of Caring, Inc. This training will be completed as of February 10, 2022. In addition to this training, Point of Caring, Inc. will conduct an administrative meeting with the house administrator, to discuss this regulatory violation and the importance of ensuring all individuals need to have a dental hygiene plan and ensuring it is written annually. Adhering to this regulation is critical in providing necessary safety for the individuals by ensuring that all medications administered by a medical trained employee are currently prescribed medications. In order to correct the violation, the discontinued medication was discontinued in the MAR immediately. Tuberculin skin testing may only be completed, signed, and dated by a registered nurse or licensed practical nurse instead of a licensed physician, certified nurse practitioner or licensed physician's assistant per 6400.141(d).The physical examination shall include: Tuberculin skin testing by Mantoux method with negative results every 2 years for individuals 1 year of age or older; or, if tuberculin skin test is positive, an initial chest x-ray with results noted. Point of Caring, Inc. was in violation of 55 PA Code Chapter 6400.141(c)(6) by failing to ensure the tuberculin skin test was completed and certified by a licensed practical nurse or registered nurse. This violation occurred due to lack of training for the house administrators and direct care staff, and failure to implement a 2-point checking system. In order to avoid future violations of 55 PA Code Chapter 6400.141(c)(6), Point of Caring will provide training to all staff, which will include the regulation as well as the proper credentials, of the medical personnel, who are completing and certifying the tuberculin skin test. This training will be provided upon the hiring of all new staff, as well as all current staff. The training is to be completed by all current direct care staff by 4/15/21. All house administrators will complete the training by 3/26/21 in order to receive proper training prior to any upcoming annual physicals. In addition, Point of Caring will attach a letter to all annual physical forms, as a reminder for all house administrators and direct care staff to request the appropriate medical personnel, and to assist in their personal review of the Individual's annual physical form, upon completion. Upon completion of the annual physical exam, the annual physical form is returned to the office and will be reviewed by the Chief Executive Officer, who is responsible for all medical information for all Individuals residing at Point of Caring. The Chief Executive Officer will review the physical form, to serve as a 2-point checking system. 6400.143(a)Individual #1 refuses annual gynecological examinations and annual mammograms; however, the individual's refusals and continued attempts to train the individual about the need for the health care examinations were not documented in the individual's record.If an individual refuses routine medical or dental examination or treatment, the refusal and continued attempts to train the individual about the need for health care shall be documented in the individual's record. Point of Caring, Inc. is in violation of 55 PA Code Chapter 6400.143(a), by failing to provide documentation of refusals and continued attempts to train the Individual about the importance of the health care examinations. This is important in order to ensure the highest quality of medical care and ensuring the Individual's health. In order to avoid future violations of 55 PA Code Chapter 6400.143(a), Point of Caring will provide training to direct care staff and house administrators of the requirements and importance of documenting refusals, the need for continued attempts and counseling, as well as the need for the physician's documentation regarding refusals and/or deferment of the medical procedure on every medical exam form and annual physical form. This training will be completed by 4/15/21 by all direct care staff and by 3/26/21 for all house administrators, in order to complete the training prior to any upcoming scheduled annual physicals. The training will also include future actions required following a refusal, which will include follow up attempts to be performed every three months, or whatever time line the physician deems necessary, this recommendation will be documented on each refusal, by the physician. Upon completion of the refusal and any follow up attempts, the house administrator will return the forms to the Chief Executive Officer, who is responsible for maintaining and reviewing all medical information for all Individuals residing at Point of Caring.
